Privacy Policy

Woonmanagement Maastricht B.V. (hereinafter referred to as: “WMM”) is the controller with regard to the processing of personal data, collected through using its services, website and social media. WMM respects the privacy of all users and considers it important, that personal data made available to WMM are collected, processed, kept and secured, in accordance with the applicable privacy legislation.

  1. Personal data processed by WMM

    1. Personal data means any information relating to an identified or identifiable natural person.
    2. Personal data are provided directly to WMM, by people looking for housing accommodation, landlords or other interested parties (hereinafter referred to as: ”the user”), for example:
      • at registration for the purpose of creating a personal account on the website of WMM;
      • at the subsequent registration to be able to schedule participation in viewings;
      • at the expression by means of an acceptance of accommodation, of the wish to rent a particular housing accommodation;
      • at the drawing up of a (sub-)tenancy agreement;
      • at notice of termination of a (sub-)tenancy agreement;
      • or when using other services of WMM.
    3. For registration for the purpose of creating a personal account on the website of WMM, the following personal data are necessary: first name, last name and e-mail address.
    4. For registration to be able to schedule participation in viewings, the following additional personal data are necessary: (mobile) phone number.
    5. For the drawing up of an acceptance of accommodation, the following additional personal data are necessary: initials, gender, date of birth, place of birth, marital status and current address. When required by the landlord, in addition to that the following further personal data can be necessary: proof of school registration, payslip or employment contract and/or a proof of employment statement.
    6. For the conclusion of a (sub-)tenancy agreement, in addition the following additional personal data can be necessary: copy passport or ID card.
    7. For a notice of termination of a (sub-)tenancy agreement, the following further personal data are necessary: end date of the (sub-)tenancy agreement, new address and bank account number.
    8. For the drawing up of an acceptance of accommodation, a (sub-)tenancy agreement and a notice of termination of a (sub-)tenancy agreement, WMM uses the software system of Housing Management Systems B.V. (hereinafter referred to as: ”HMS”). At signature of an acceptance of accommodation, a (sub-)tenancy agreement and a notice of termination, the IP address used to sign is recorded via the software system of HMS.
    9. Also without a personal account on the website of WMM, services that require the provision and therefore processing of personal data, can be purchased from WMM.
  2. Purposes processing personal data

    When the situation arises WMM uses the personal data of users for the following purposes:

    1. General user contact

      WMM uses the personal data provided by the user, for the provision of the services requested by the user. This may be the following services: receive notification in case of updates of the rental offer, offering the possibility to schedule participation in viewings of housing accommodation, proposing as candidate tenant to a landlord, drawing up a (sub-) tenancy agreement, notice of termination of a (sub-)tenancy agreement and providing any other possible services. A copy of a passport or ID card will only be made, in case it is necessary for identification purposes. In these cases at processing, through the copy the following text will be written repeatedly: “copy for the purpose of a rental agreement”. IP addresses are only recorded for the purpose of authentication of signatures.

    2. Social media

      When the user requests access to the website of WMM, the user can choose to link his social media account to the website of WMM. Should the user do this, the user can also log on to the website of WMM, via social media. In this context, WMM processes the user's personal data, only to the extent necessary to enable the users’s log on to the website of WMM. With regard to the further use of social media, for information on the processing of personal data, the user is referred to the privacy policy of the relevant social media.

  3. Automated decisionmaking

    Decisions that may have consequences for the user, does WMM not solely base on the automated processing of personal data.

  4. Providing personal data to processors

    WMM will make personal data available to processors, to the extent necessary for the provision of services by WMM. These processors will process the personal data, in accordance with the instructions of WMM and under the responsibility of WMM. This is defined in a processing agreement, that WMM will conclude with these parties.

  5. Providing personal data to third parties

    WMM provides personal data to:

    1. Candidate contractual counterparty of user

      WMM only provides personal data to a candidate contractual counterparty, if and in so far as necessary in the context of the conclusion of a (sub-)tenancy agreement desired by the user and in the context of a notice of termination of the (sub-)tenancy agreement by the user.

    2. HMS

      WMM uses the software system of HMS, for the processing of data for the purpose of drawing up and signing an acceptance of accommodation, a (sub-) tenancy agreement and a notice of termination of a (sub-)tenancy agreement. This software system of HMS is only accessible for WMM, through its own secured portal on the website of HMS. The security of this portal meets the requirements that can be reasonably set, based on contemporary technology. WMM remains responsible for this processing on the website of HMS.

    3. Legal obligation

      WMM also provides personal data to third parties if WMM is obliged to do so on basis of a legal provision, a court order or a supervisory authority, or if this is necessary in the interest of preventing, detecting or prosecuting criminal offenses.

    4. To other third parties WMM only provides personal data, if and in so far as the user has given his consent.

  6. Transfer of personal data outside EU

    The third parties to whom WMM provides personal data, may be located outside the European Union or use servers located outside the European Union. Transfer of personal data to countries outside the European Union, will only happen if the country concerned guarantees appropriate safeguards.

  7. Security measures

    1. WMM respects the privacy of the user and ensures that personal data are treated confidentially and with the greatest possible care. Only authorized personnel have access to the personal data of the user.
    2. WMM makes every reasonable effort to protect its systems against loss and/or any form of unlawful use or processing of personal data. To that end WMM uses appropriate technical measures, taking into account the state of the technology.
    3. WMM will in compliance with the applicable regulations and any reporting obligation, carefully determine how to deal with an unexpected data breach.
  8. Retention period of data

    WMM will not store personal data longer than necessary, for the aforementioned purposes and for compliance with applicable laws and regulations. The storage period depends on the purpose, for which the personal data are processed. After it is no longer necessary to keep personal data, they will be destroyed by WMM.

  9. Rights of users

    The user has certain rights with regard to his personal data. This applies in particular to the right of access to personal data, rectification and addition, restriction of processing and erasure. For this purpose, the user can contact WMM via: info@wmm.nl. In case of requests WMM may request additional information, for the purpose of verifying the applicant's identity.

  10. Questions and complaints

    If the user wants further information or has any questions or complaints about the processing of his personal data, the user is requested to contact WMM in writing, by e-mail: info@wmm.nl or via the postal address: WMM, Alexander Battalaan 79 A01, 6221 CC. In case the user has additional questions and complaints about the processing of his personal data, the user can submit these at all times to the Dutch personal data protection authority (Autoriteit Persoonsgegevens).

  11. Adjustment Privacy policy

    WMM reserves the right to unilaterally modify or complement this Privacy Policy, by adapting this page. You are therefore advised to consult this page regularly. In case of substantial changes in this Privacy Policy, a clear notification will follow via our website.
