I want to terminate my tenancy agreement; how does that work?

Written termination 
The tenancy agreement must always be terminated in writing by e-mail or by registered letter. As soon as we have received the letter you will receive a written confirmation from us. The lease can also be terminated via the tenant portal on www.hmsystems.nl.


Notice period 
In the tenancy agreement you can find the minimum notice period. For most living spaces this is at least one full calendar month. You should also check your agreement to see if the minimum rental period has already expired. Please note that it is not possible to terminate your tenancy agreement halfway through a month. 


Where can I send my lease termination letter to? 
You can send your termination letter by email to info@wmm.nl stating:
- Your full name
- Telephone number
- E-mail address
- Address of the rented property
- Date of cancellation

What is the notice period for terminating my tenancy agreement?

Notice period 
In the tenancy agreement you can find the minimum notice period. Usually, a notice period of at least 1 calendar month applies to rented accommodation. Before you send the notice, please check if there is a minimum rental period and if it has already expired. 


Moving halfway through a month 
The notice period for residential accommodation is at least 1 full calendar month (stated in your contract), so it is not possible to let end the rent halfway through a month.

What if I terminated my tenancy agreement too late?

Late termination 
If you have sent the lease termination letter too late, the termination will automatically be postponed to the end of the next month, even if it is only one day late. Therefore, it is of utmost importance to make sure you send your termination letter in time. The notice period is at least 1 calendar month, so it is not possible to move to another house halfway through a month. 


Example 1 (correct termination) 
If you want to move on 31-05-2025, please make sure you send us your termination letter no later than 30-04-2025. If you send the cancellation after 30-04-2025 you are too late. 


Example 2 (late termination) 
If you want to move on 31-05-2025 and you send your termination letter to us on 01-05-2025, you are too late. The end date will then automatically be postponed to 30-06-2025.
 

Am I allowed to nominate a replacement tenant for my rented property?

Nominating a new tenant 
It is not possible to nominate a new tenant. Woonmanagement Maastricht selects a new candidate for the properties that become vacant according to the regular selection procedure..

May I sell or hand over furniture and other goods to the new tenant?

Rules on selling or handing over furniture 
It is not allowed to hand over or sell furniture or other personal possessions to the next tenant. Upon conclusion of the tenancy agreement, the living space must be completely empty and clean. The only case in which this rule does not apply is when the rented property is furnished. In that case only the furniture and objects that are included in the tenancy agreement remain in the property.

How should I hand over the property after conclusion of the tenancy agreement?

Handover procedure 
At the end of the tenancy agreement, the keys must be returned to our office. After receiving the keys, an employee of Woonmanagement Maastrichtwill visit the location to do the final inspection of the rented accommodation by means of photos. These photos will be sent to the tenant and landlord by email. The rented property must be handed over completely empty and clean. Furthermore, you are required to restore the property back to its original state as it was at the start of the lease.


Hygiene 
For the final inspection, make sure that the rented property has been cleaned properly and that the property is completely free of personal belongings such as furniture and other objects. 


The property is furnished 
In case you have rented the house including furniture, you have to make sure that all furniture is back in its original place and that it is well cleaned so that the new occupant can use it immediately. 


Checklist
Clean and cleared:
- Remove dirt, grease and limescale from the kitchen, sanitary facilities (including tiles and joints) and taps;
- Any built-in equipment must be made clean, free of grease and function properly again (also grids of the extractor hood must be grease-free);
- Clean the drains, sink, toilet, etc.;
- Taps and other sanitary facilities, such as the shower fittings, are undamaged and functioning;
- Remove stickers and glue residue on doors, cabinets, etc.;
- Completely remove dust from the living area, including window frames, radiators, skirting boards, window coverings;
- Leave waste containers empty and clean (incl. waste disposal card if applicable);
- Mechanical ventilation grids are clean and functioning;
- Empty and clean any basement, balcony or shed;
- All floors, including garage and storage, are vacuumed and/or mopped (depending on the type of floor);
- Leave instructions for use, filling hose, filling key and venting key with boiler (if present); 

Maintenance at your expense:
- Repairing consequential damage to floors (holes, cement and glue residues, broken skirting boards);
- Skirting boards and sills are undamaged and without any paint residues and, if painted, must be handed over in a light color;
- Walls and ceilings must be delivered free of damage;
- Any decorations and stickers must be removed, and any consequential damage must be repaired;
- Remove nails, screws, etc. from walls, floors, and ceilings;
- Remove plugs and seal holes neatly. (If the repairs cause unsightly stains, they should be painted over);
- In case you painted any walls of the housing, these should be restored to their original color;
- All light switches and sockets must be undamaged and functioning. They must be unpainted, and clean;
- Self-installed loose cords and cables must be removed;
- Place terminal blocks on exposed power lines;
- All doors must be present and close properly. The doors are free from scratches, holes or other damage;
- All handles and locks are functioning properly;
- All keys of interior doors/windows must be in the keyholes;
- All keys of exterior doors (including duplicates) must be handed in at the final inspection;
- All windows are mechanically in order and close properly;
- The window frames are undamaged, windows do not have any scratches, cracks, stickers, or glue residue;
- Window sills are present and undamaged;
- Holes in window frames must be repaired;
- Holes in wall and floor tiles and joints must be repaired and/or tiling must be replaced;
- The bathrooms are complete and undamaged (pay attention to cracked toilet bowl, missing or broken toilet seat, damaged shower tray/bath, leaking or non-functioning taps);
- The kitchen is undamaged (pay attention to kitchen worktop, hinges of kitchen cabinets, damage to doors and content of cabinets);
- If there is a garden or balcony present it should be neatly maintained and handed over free of personal belongings and weeds.

When does Woonmanagement Maastricht do the final inspection?

Final inspection 
At the end of the tenancy agreement the keys must be returned to our office. After receiving the keys, an employee of Woonmanagement Maastricht will visit the location to do the final inspection of the rented accommodation by means of photos. These photos will be sent to the tenant and landlord by email.


Making an appointment for the final inspection 
No appointment has to be made for the final inspection. Once the rented accommodation is completely empty and clean, the keys can be returned to our office and we can carry out the final inspection. The rented accommodation must be delivered no later than the last working day of the month. Of course, it is always possible to arrange the key handover sooner.

Where can I hand in the keys?

Handover of keys 
The keys must be handed in at our office at the Alexander Battalaan 79 in Maastricht. It is not allowed to leave the keys unattended in the rented property or to hand them over to a housemate or neighbor.

When will my security deposit be returned?

Return of security deposit 
Normally, the deposit will be settled no later than two weeks after the end date of a lease. If damage has been caused by the tenant to the rented property, it must first be determined what the repair costs will be, refund can then in some cases take longer.  When and how soon your landlord must return the security deposit is not legally defined.

Can I use my security deposit as rent payment in the last month?

The deposit may legally never be used to cover the rent of the final month of the tenancy.
